My name is not on the title, can I claim it in my divorce?

I%26#039;m divorcing my husband and last year we refinanced the house. Because of my bad credit, my name could not be on the loan papers, but I did sign I was responsible if he defaulted on the loan. First, is my name on the title/deed? Second, can I claim 1/2 ownership of the house in our divorce?

Rather you live in a community property state or not, anything purchased during the marriage using martial funds (which is pretty much anything earned during the marriage) is martial property and subject to division. It doesn閳ユ獩 matter if your name is on the title or not.

It depends on what state you file for divorce. If you are in a community property state, then yes. Everything is owned by both of you in that case, property and debt...

You need to talk with a lawyer. All states are different. If you live in a community property state, half the proceeds of the house will be yours. Be sure you don%26#039;t sign a Quit Claim Deed because then you would have no claim to the house. Don%26#039;t let him trick you! Go see a lawyer. And if you are divorcing, you need your own lawyer! Don%26#039;t use his lawyer because you will get screwed good because his lawyer will have his needs in mind and not yours.

What did he do to deserve a divorce?

If he deserved it, then get a lawyer, give him all the materials, and don%26#039;t look back Who wants the memories.

Get a lawyer%26#039;s opinion on this in your locality. It depends if your state is a joint property state where property and debts are shared 50%. If it%26#039;s not then if you%26#039;re name is not on the title then it is most likely his and you%26#039;re not entitled to it unless you can prove in court you%26#039;ve paid X amount of $ towards the home and then you can be compensated for that -- maybe.

In almost any state the answer will be yes. Whether you are in a community property or an equitable distribution state - the court will have the authority to award you a share of the value of the home.

Good luck.

It is a marital asset, you will probably be given 50% of it...but get a lawyer first and have the lawyer look over the paperwork on the house.
